Notice and Takedown Policy for Loving The Classics
As a professional and reputable online store, Loving the Classics is committed to complying with copyright and trademark laws. In accordance, we have developed a robust response to Notices from third parties alleging violations of Copyright in materials we offer online, and policies to take down materials that violate such laws. In order to protect Intellectual Property Rights (IPR) of third parties, as well as our own customers, our policy is to promptly respond to third parties’ notices of alleged IPR infringement. We do, however, require proper notices from such third parties regarding content that they claim violates the law.
Please note that the items listed on our website are from the open catalog that we have of movies and TV shows (from TMDB, and OMDB APIs). The items that are not released yet, or not out on DVD / Blu-ray are indeed unavailable, and that is what we would tell our customers if the requests ever come in.

When these are available, and someone indicates an interest in them, we tell our customers when and if the products they request come in.
While Loving the Classics is not a legal expert in IPR matters we do exercise reasonable diligence to ascertain whether a product is in the public domain or is subject to copyright. If we are listing it in the public domain, we in good faith believe it to be in the public domain.
However, if we are mistaken and a product we offer is not in the public domain, we welcome all assistance to comply with copyright law and/or any trademark law issue that might arise. If you believe there may be an alleged infringement (or infringements) of your IP rights on our website, please follow the Notice requirements set out on this page to bring such a claim to our attention in order to resolve the issue.
If you believe an intellectual property right has been violated on Loving the Classics, please submit a Notice of the alleged IP infringement to us to include the following:
1. The full name of the intellectual property right’s owner;
2. Your full name and, if pertinent, the full name of the Company you represent;
3. Your mailing address (include your City, State and Zip Code, or otherwise a proper mailing address to reach you and your Company if outside the domestic U.S.);
4. Your contact email address and your telephone number (along with your international dialing code if your number is outside the domestic United States);
5. A complete description of the alleged intellectual property right you claim is infringed (as defined under 17 USC §1 of the US Copyright Act, or if related to Treaty law under the Treaty, such as the Berne Convention for Protection of Literary and Artistic Works. 6. Explanation of the alleged infringement and how Loving the Classics violates such copyright interests and, if pertinent, the location of the violation on the Loving the Classics website;
7. Your signed and dated statement, addressed to Loving the Classics at the above referenced email address, signed in front of a notary public in your jurisdiction, when signed by you, stating the information provided is true and correct, and that you believe in good faith that an IPR has been violated, all of which should be stated in accord with your descriptions of the alleged violation listed under items 5 and 6, above;
8. Your signature of the following indemnification Agreement:
(I/We) ________________________________________(Insert the Claimant’s Name(s) and/or Company’s Name) do hereby covenant and agree to defend, indemnify and hold harmless, absolutely and unconditionally, Jarrett Enterprises, Ltd., dba Loving the Classics ("LTC") from and against any and all damages, losses, claims, demands, actions, causes of actions, costs, expenses, liabilities and obligations of any kind whatsoever, including, but not limited to, attorney's fees, arising out of, related to, or connected with a false declaration of statement of fact asserting LTC’s copyright infringement as referenced in our Notice of Copyright Infringement dated: ______________________ (Insert the date of your Notice of Copyright Infringement). _________________________ (Insert your signature or that of the Claimant, with date of signature – and send by scanned attachment with your Notice of Copyright Infringement Claim to the above referenced email address).
